When selling your home it is important to have clarity about what your goals are before accepting an offer.  Many times in real estate there is a lack of discussion of the Seller’s needs prior to advertising the property.  This can be quite detrimental to a Seller as he or she may be responsible for very costly items that were not properly excluded or addressed in the listing stage or the negotiation stage.  Once the Seller agrees to a term in writing the Buyer generally has no obligation to change the terms.

For example, if a storm blows over a tree while the sale is pending, the Buyer generally has the right to insist that the tree is replaced.  This can quickly become a very costly issue with some of the pristine palm trees and exotic tropical plants used in our landscaping.

Another example is if there are multiple offers on your home, should you disclose the multiple offers to each buyer or would this potentially prevent a deal from coming together?  We advise our clients how to respond to this and other scenarios based on the specific listing and the current market trends.
